Lewis and Clark Caselist



The following caselist was collected at the Lewis and Clark Tournament this
past weekend.  The information includes disclosure information on all of
the open teams and some of the junior and novice teams.  School, Team Name,
and Case Name are on the first line.  Then comes the plan text, case
structure and key sources.

One note:  Disclosure forms are new to the Northwest and so many forms came
back in with paraphrases of the plan text.  We tried to track down the
actual texts for those that we suspected, but a few may have slipped
through.  Please correct any mistakes.

For those people who were at Lewis and Clark:  Professor Hunt put more
categories on the disclosure form than are represented below.
Unfortunately, too many of the forms were filled out incompletely so I left
that information out so that there was equal disclosure.

CEU BA  --  Native Sovereignty (Amend SMCRA)

The SMCRA (Surface Mining Control and Reclamation Act) should be amended
according to the advocacy of Navajo President Albert Hale and should
contain these following provisions:  recognition of native regulatory
primacy, the allowance of deterent taxation by native governments, recovery
programs funded 100% thru reallocation of OSM money in current reclamation
programs, and full transfer of authority from the Office of Surface Mining
Control and Reclamation to native nations.  Current SMCRA regulation
limited to coal mines shall be expanded to include all mines on native
lands.  All logistical provisions will be done normally and optimally.

O1:  Mining on native lands is bad.
O2:  Returning control to Native Americans solves.
S1:  Mining Destroys the Enviroenment (water and air pollution)
S2:  Sovereignty transforms society (solves wider consciousness, racism,
sexism, militarism and police state).

CEU Zahler and Westerfield  --  Municipal Waste

Pass Richardson municipal waste bill to reduce incinerators and encourage
recycling.  Use sulfer based coal polymer concrete.

O1:  Status Quo Uses Incinerators (instead of waste management)
O2:  Incinerators Bad (doxins, heavy metals)
O3:  Recycling Good
O4:  Richardson bill only uses incinerators as last resort, increases recycling.

Gonzaga Brewer and McLoughlin  --  Tradeable Emissions to Solve Warming

Use tradeable emission permits to decrease CO2 to 1990 levels by 2000.

Gonzaga Browder and Yake  --  Vitrification

All nuclear waste will be vitirifed where it currently rests or is
produced.  Funding from Yucca funds and Department of Transportation.

O1:  Status Quo is Not Solving for Waste (which is bad, risks terrorism,
and encourages prolif).
O2:  Vitrification Solves.



Gonzaga Hunsinger and Voight  --  Methyl Bromide

Ban use, production and ownership of methyl bromide.  The EPA  under title
VI of the Clean Air Act will implement regulations banning all domestic
use, production (in agriculture and fumigation) and ownership of methyl
bromide in the United States.

O1:  Use Continues.  EPA phaseout by 2001.  US ag is the largest user.
O2:  Health Harms.  Methyl bromide leads to acute health problems and
death.  Is more poisonous than any other pesticides.  Circle of Poison.
O3:  Ozone Harms.  Ozone is depleting fast.  Methyl bromide is key.
Nonlinear.  Many deaths and cataracts.  Kills Phytoplankton.  Threatens all
life.
O4:  Ban Solves.  EPA should act.  US action is modelled.  Banning restores
non-chemical alternatives.  Solves ozone.  History proves.



Gonzaga Headridge and Westergren  --  Hazardous Waste

Expand definition of hazardous waste to include incinerator ash and
domestic sewage.  Expand enforcement of CERCLA and RCRA.

O1:  Inherency  (Loopholes = no waste reduction)
O2:  Solvency  (Expanding CERCLA and RCRA closes loopholes)
A1:  Harms Health and Environment
A2:  Ecoimperialism (North/South, Stop duming waste in other countries.)

Gonzaga Moburg-Jones and Peterson  --  Nitrogen Oxides

The EPA will regulate nitrogen oxides through a tradeable permit system
without any command and control components.  The EPA will establish the
system to require the full reductions legislated by the 1990 Clean Air Act.

O1:  Inherency.  EPA is not effectively regulating NOx now.
O2:  Harms.  Smog.  Acid Rain.  Species.
O3:  Solvency.  Tradeable permits solve.

Gonzaga Olson and Purdy  --  Environmental Labeling

Adopt uniform definitions and standards promulgated by EPA.  Defintions and
standards based on Green Report II.  Plan modeled after David Welsh's
proposal.  Enforcement through EPA and State and FTC co-op.

O1:  Deceptive Eco-Marketing is Growing
O2:  Status Quo Regulations do not Solve Deception
O3:  Solvency -- Federal Government should adopt uniform EPA definitions to
solve for the environment.



Lewis & Clark Hager and Huey  --  Environmental Racism

Solve environmental racism thru Bullard's environmental justice framework.
Implement LULU point system to redistribute pollution.

1:  Health.  Minority communities are getting lots of bad pollution dumped
on them.
2:  Riots.  Environmental racism is causing riots.
3:  Racism.  Morally wrong.  Environmental genocide.

Change the framework of environmental discourse from a microphase to a
macrophase discourse.

No change can occur until the real problem of environment is discussed.

The BLM, USFS and other relevant federal agencies will increase regulations
on the beef industry by:  eliminating subsidies and increasing grazing
fees;  requiring ranchers to raise bison;  requiring ranchers to convert to
bison production, penalties for noncompliance are aquisition of lands;
requiring ranchers to take down fences.

O1:  Inherency.  Subsidies.
O2:  Solvency.  Bison solve.
A1:  Drug resistant disease.  Beef will lead to, bison won't.
A2:  Habitat.  Saves the ecosystem and species.
A3:  Famine.  Beef use of grain causes starvation.

Oregon Vollieque and Gough  --  Casini Mission

The US Federal Government will increase regulation of the Space Industry by
implementing a "no-production of plutonium 238 for energy use" in space
policy.  Plan will be enforced by the Nuclear Regulatory Commission.

O1:  NASA and Pentagon in Bed Together.  They're committed to a nuclear
space program.
S1:  Nuclear Production Contaminates Workers
S2:  Accidents Terrible -- Worldwide Cancer
S3:  Solar Power could Replace Nuclear



Oregon Vollieque and Gough  --  Ban Uranium Mining

The US Federal Government through appropriate regulatory agencies, will set
the level of domestic production and emission of radium and radon by the
mining industry through the process of uranium mining to zero by banning
uranium mining.

O1:  Inherency
A1:  Uranium Kills



Pacific  ???  --  Cigarettes

$2 tax per pack.

O1:  Harms - 10 million die worldwide each year, teens sucked into addiciton.
O2:  Inherency - No Enforcement Laws
O3:  Solvency - Increasing tax leads to decrease use, also raises money.
Everyone likes $2 per pack tax.



Pacific James and Hill  --  Medical Waste

Create a universal definition of medical waste.  Phase-out PVC, unclarify
fetuses as medical waste.

O1:  Federal Government Not Acting Now
O2:  Federal Defnition Need to Solve
A1:  Incineration -- Phase Out PVC Solves (dioxin and mercury emission bad,
case solves)
A2:  Asthma -- Incinerators lead to asthma.
A3:  Fetuses -- Proper Burial, fetuses are being burned.

PLU HY  --  Lawn Mowers

Department of Agriculture will advocate a switch to push mowers.  All
companies manufacture wick engines instead of internal combustion engines.
And distribute informational literature.  And, we ask, that the airlines be
quiet because it disturbs the birds.

O1:  Inherency.  Not happening now.
A1:  Emisions are bad for you.  Push and wick mowers solve.
(Nothing at birds.)



Puget Sound All  --  Indoor Air Pollution

The U.S. federal government will increase regulations to substantially
decrease the domestic emission of environmental pollutants by adopting
regulations requiring industries to decrease the emission of indoor air
pollutants.  Our plan will be based on the suggested OSHA regulations which
include the following:  implement an indoor air quality compliance program
following ASHRAE standards for clean air; keep main heating and coolling
systems operating 24 hours a day; devise procedures during renovation and
remodeling activities that restrict entry of dust, paint, and other
contaminants; regulates humidity so that it never going above 60%;
maintains a log of indoor air comlaints and managements response; and
provides outside air ventilation when ever the building is occupied
Funding and enforcement guaranteed through OSHA.

Harms:  People suffer from indoor air pollution.
Inherency:  Nothing is being done now.
Solvency:  Plan actions solve.



Washington Lester and Beal  --  Tobacco

Ban cigarette advertising.



Washington Martin and Roberson  --  Levins plan for energy efficiency.

The US government, after consultation with Amory Lovins, will implement his
energy efficiency program, including, but not limited to:  fossil fuel
subsidies phaseouts, market regulation of the power industry, tax credits
to businesses to purchase efficient technology, etc.  Funding through
redirection of fossil fuel subsidies.

I.  Congressional action on energy program ensures fossil fuel dependency.
II.  Sleep walking into disaster.  Oil shocks coming.  Lead to economic
depression.  Chaos and war.  US Agression slaughters millions.  Global
nuclear war.
III.  Government pushing will increase efficiency.  Prevents pollution and
sustains the economy.  Solves danger of oil war and restores stability.

Congressional and Executive Order will pass NISA as proposed in HR3217 and
SB1660 as modeled after the Great Lakes Ballast Management Program.

Ballast water being dumped on the coasts.  NISA equals dumping in the deep
ocean.  Advantages species and diseases.

Modify the Toxic Release List by adding seven new industries to it through EPA.

Western Washington VanHorn and Foss  --  Yucca Mountain

When the department of energy applies to the United States government's
nuclear regulatory commission for a liscense to dispose of nuclear waste at
Yucca mountain it will be denied.  Current funding allocated for research
at Yucca will be shifted towards on-site storage and exploration of
alternatives until a safe solution is found.

O1:  Waste Goes to Yucca
O2:  Worst Place to Put It.  Water contamination.
O3:  Sovlency.  Yucca bad, onsite good.

Western Washington Yogi and Johnson  --  Noise Pollution at National Parks

The FAA and NPS will adopt regulations requiring industries to decrease
noise in national parks.  Ban overflights in some parks.  Protect quiet in
some parks.  Cap tour licenses.

I.  Noise is a pollutant especially when in quiet national parks.
II.  Reduced noise equals solitude which is good.
III.  Reduced noise helps spirituality ceremonies of Native American peoples.



Whitman Symonds and Harris  --  Particulate Matter

The EPA will issue a regulation establishing a performance standard
requiring all relevant industries to decrease the production and/or
emission of particulate matter 2.5 microns in diameter to 10 micrograms per
cubic meter.

O1:  EPA fails to address particle pollution.
O2:  Particulate pollution is deadly.
O3:  Our standard solves for 56,000 lives/year.
