1. no way to dilineate plan from rest of infotech, ie info tech is 
necessary as a base for plan
2. not a logical perm, what is the reasoning behind it?  In other words, 
why keep this one form of infotech
3. precedent set by case.  If case is possible all others are by rules of 
fairness, ie what is so special about this case?
4. cannot put plan in a vaccuum, this would be abusive to the neg because 
it would limit the real world impacts.
