Brian,

    I think you've hit the nail on the head in at least several key
ways:

First, the TR anlogy is overworn and should be discarded. I find your
standard of least intervention (LI) to be a noble attempt to capture
the unspoken judge philosophy that best describes how most judges are
operating.

Secondly, we need to be establishing community consensus on what
should be considered appropriate LI. It is important that a standard
of limited intervention never be used to cover up laziness in
judging. Ignoring arguments because you are predisposed against them
is vastly different than simply ignoring arguments because you are
predisposed against the person making them.

Thirdly, I agree wholeheartedly about your feelings regarding the
conclusion of the Bunch essay. His conclusions seem incongruent with
his own analysis. Personally, I was most dismayed by his almost
total desire to ignore the policy consequences of his own suggestions.
