First, I don't consider penalties designed to prevent unethical behavior to
be draconian.

Second, there has to be some way to control what might be becoming a problem.
If we simply look the other way, it will send a message to others that the
organizations condones this behavior.

Well, the situation you described was FAR from the topic we are discussing.
In your case, the judge ASSUMED some sort of out of context claim. The
penalties I mentioned would be for people who had been tested and (convicted
if you will) were found to have violated some ethical standard.

Actually, war stories are good for example analysis. They are the best ways
to look at an example and say "yes, that is out of context", or "no, that is
alright". Without war stories, we are relicated to making up our own
situations to judge.
