An ethical discussion: temporarily on hold



1.) a discussion, semi-private, is happening already.
2.) a public discussion guarantees a better right to respond.
3.) a public discussion allows the community to grapple with
consensual standards.
4.) a public discussion is a good accompaniment to attention by a
CEDA committee (Dr. Duke and Dr. Hunt are currently looking in to
the formation of such a committee).

Several individuals noted specific concerns:

1.) Is there real evidence of abuse?
2.) Would a listserve discussion avoid politicization?
3.) Could a listserve discussion avoid undue attacks upon
character/reputation?
4.) Are there applicable standards for evidence use?
5.) Are there legal implications, slander etc.?
6.) Would the names of the parties have to be revealed?

At present, I believe that the answer to all of these questions
(including #5 and #6) is yes, but a further discussion of why
each answer is yes (especially for #1) would necessarily start
the discussion by broadcasting the who/what/when of the specific
incident.  Believe it or not, there is a reason why an answer to
the "proof" question would necessarily reveal (or at least give a
really broad hint of) the "who" question.

At present, I am going to wait on starting the discussion myself. 
I would respectfully ask that others wait as well.  I think there
are a couple reasons for waiting:

1.) there is currently movement toward putting together a CEDA
committee to the incident, and more generally to look at
standards for evidentiary honesty and to consider a process for
resolving disputes.  I think this committee may want input on the
value or form of this discussion. 

2.) There are a few people that are currently trying to get a
hold of me and I want to wait on their input.  

3.) I am in discussion with a few people on why discussion should
not take place.

4.) Bottom line, I want legal advice. 


     I apologize if this apparently torturous process is creating
frustration.  But I think that the issue is of vital importance,
and that any specific discussion should be preceded by careful
thought.
